Lawsuit Challenges Ukraine's Ban on Scrap Metal Exports
A lawsuit has been filed with the Kyiv District Administrative Court by the company 'Zakhidvtlom' LLC and the public union 'Ukrainian Association of Secondary Metals and Resources.' They seek to overturn a Cabinet of Ministers decision that imposed a zero-export quota on scrap metal. This legal action is part of an ongoing conflict between the government and scrap metal exporters. Deputy Head of the Verkhovna Rada Committee on Economic Development, Dmytro Kysylevskyi, stated that schemes to evade customs duties, which operated through the European Union, cost the state 3.5 billion hryvnias last year.
This marks the third lawsuit filed by 'Zakhidvtlom' LLC with the same court; two prior claims and two motions for interim relief were returned by the court. The 'Ukrainian Association of Secondary Metals and Resources,' whose founders include many scrap exporters, has joined the case. Lawyer Yevhen Maistruk is representing the plaintiffs.
Government Commentary and Position
Dmytro Kysylevskyi emphasized that the government enacted the zero-quota policy based on national security considerations.
He also noted that politicians from Poland's 'Confederation' party have advocated for the resumption of raw material exports. Kysylevskyi contends that combating the shadow scrap metal trade is a national security issue, and the shadow operators that emerged and became entrenched during the Yanukovych era must become a thing of the past, along with the outdated economic model built on raw material exports.
According to Kysylevskyi, this is the fourth attempt by scrap metal dealers to use the courts to block and cancel the Cabinet's decision on zero export quotas. In previous attempts, they filed claims and then withdrew them after a judge was assigned, which he suggests indicates a search for a 'favorable' judge. The deputy committee head stated this situation reveals a fight by dealers to continue profiting from funds that could otherwise support the military.
The dispute over the scrap metal export ban is a significant element of Ukraine's wartime economic policy, where securing state revenue is critical. The government's decision to restrict scrap exports was made to combat shadow economy practices that drain state coffers. Such legal battles could impact the stability of Ukraine's secondary metals market and the formation of its tax base amid ongoing economic challenges.
