The ByteDance-MPA Agreement

On August 18, 2023, ByteDance signed a memorandum of understanding with the Motion Picture Association (MPA) to tighten copyright safeguards across its artificial intelligence systems. The agreement came after a dispute that began in February, when the MPA demanded that ByteDance stop using protected material without proper authorization. It is the latest response to growing unease over how AI companies handle creative works.

What the Deal Covers

The memorandum applies to all of ByteDance's AI models, including those powering TikTok, TikTok USDS, CapCut, and Dreamina. The MPA, whose members include Disney, Paramount, and Warner Bros. Discovery, noted that the Seedream 5.0 Pro and Seedance 2.5 models show clear improvements in copyright protection. In its statement, the MPA said these versions include new features that reflect stronger safeguards.

ByteDance has also agreed to impose tighter limits on the unauthorized use of other parties' intellectual property and of people's likenesses. As part of that effort, the company paused the global launch of Seedance 2.0. The deal signals ByteDance's intent to raise its copyright standards across its products.

At the same time, U.S. studios are continuing a copyright lawsuit against Midjourney, which illustrates how pressing intellectual-property disputes have become amid the rapid expansion of AI technology.

The ByteDance-MPA agreement represents an important step by a major tech company to bring its AI tools in line with copyright requirements, an issue that is becoming increasingly significant as AI plays a larger role in creative fields. It may also influence future legal standards for digital technology and intellectual property, as other companies could follow ByteDance's approach to resolving such disputes.
