Darnytsia District Prosecutor's Office Files New Lawsuit
The Darnytsia District Prosecutor's Office in Kyiv has filed a lawsuit to compel the Kyiv City State Administration (KCSA) to clear an illegal landfill on Kolektorna Street. This marks the second such legal action the prosecutors have taken against the city administration over this specific site. The dump, located in Kyiv's Darnytsia district, covers an area of nearly 0.7 hectares and is used for the disposal of household and construction waste. The total contaminated area was officially documented with the assistance of specialists from the State Environmental Inspectorate of the Capital District.
An earlier lawsuit from the prosecutor's office, which is still under judicial review, also demands the removal of waste that has spread from 15 Solomiia Krushelnytska Street towards Kolektorna Street. In a related development, a separate unauthorized landfill covering 2.5 hectares along Vyshhorodska Street in the Obolon district was recently cleared. The land on Vyshhorodska Street is designated for agricultural use and is managed by a state-owned enterprise.
Court Ruling and Environmental Concerns
The Northern Appellate Commercial Court has upheld a prior ruling by the Kyiv City Commercial Court, which sided with the Solomianska District Prosecutor's Office. The court ordered the municipal utility company 'SHEU of Solomianskyi District of Kyiv' to eliminate an illegal dump in the 'Balka Pronia' park. Prosecutors have noted that the KCSA, as the body authorized to handle such waste sites in the capital, has failed to take action to remove these uncontrolled dumps, indicating official inaction.
This ongoing legal battle highlights a severe and growing problem with illegal landfills in Kyiv, raising significant concerns for public health and environmental safety.
The repeated lawsuits from prosecutors point to a systemic failure by local authorities to adequately address the city's waste management crisis. Clearing these sites is a critical step for improving Kyiv's environmental conditions and meeting basic obligations for a clean urban environment. The situation reflects broader challenges in municipal governance and enforcement of environmental regulations in Ukraine's capital.
