Legality of Restaurant Generator Fees
Ukraine's State Service for Food Safety and Consumer Protection has clarified the rules for restaurants adding a separate charge for generator operation to customer bills. According to Deputy Head Andrii Kreitor in a comment to Hlavkom, such actions constitute a consumer rights violation if the establishment did not warn customers about the additional fee in advance. This situation has emerged as some businesses seek to offset costs during periods of unreliable public power supply.
Under Ukrainian law, specifically the Law of Ukraine 'On Consumer Rights Protection,' businesses are required to provide complete, reliable, and clear information about goods, services, and their prices. If a bill includes a line item for 'generator service' without the customer actually ordering it, this could be considered an imposition of service or deception of the client. The costs for fuel and equipment maintenance are considered the restaurant's own operational expenses.
Potential Consequences for Violations
Businesses found in violation of these rules may face fines of up to 30% of the value of goods or services sold, but not less than 85 hryvnias. As of today, the service has not received any consumer complaints regarding generator charges on bills. A public discussion erupted earlier on social media after a restaurant receipt surfaced showing a separate line charging a customer for generator operation.
"The law obliges businesses to provide consumers with full and understandable information about goods, services, and their price. If an establishment clearly informs visitors in advance that generator costs are already included in the price, no violation occurs,"
Andrii Kreitor
Therefore, restaurants must adhere to the legislation to avoid potential violations and penalties.
This case underscores the importance of transparency in business-consumer relations. Consumers should be confident they are receiving complete information about the cost of the services they order. In the event of violations, consumers have the right to contact the relevant authorities to protect their rights. This incident may also prompt a review of service practices in restaurants to avoid similar misunderstandings in the future.
