The Legal Consequences of Fraudulent Medical Certificates in Poland

In Poland, the use of forged sick notes (known as L4) is a serious offense that can lead to both disciplinary action and criminal prosecution. The Social Insurance Institution (ZUS) and employers are actively conducting inspections to uncover such abuses. This issue has become a significant focus for authorities aiming to protect the integrity of the social security system. Submitting a fake certificate of temporary incapacity for work carries severe repercussions for both the employees who use them and the doctors who issue them.

Penalties for Document Fraud

Under the Polish Penal Code, tampering with medical documents falls under Articles 270 or 271. An employee found to have knowingly used a false document may face:

  • Substantial financial penalties;
  • Restriction of liberty;
  • A prison sentence of up to 5 years.

For a doctor, entering false information into the system constitutes a crime by a public official. If a sick leave is proven to be fraudulent, the offenders are required to repay 100% of the benefits they received.

Furthermore, an employer has the right to terminate an employee's contract immediately, without notice. ZUS employs automated systems to monitor sick leave patterns, which helps flag potential misuse. Inspectors also have the authority to verify an employee's compliance with sick leave regulations at their place of residence.

'We routinely check not only the legitimacy of issuing an L4 but also whether the employee is using that time to recuperate, as required by law,' states a ZUS representative.

The prevalence of fake sick notes in Poland highlights the critical need for oversight within the social insurance framework. Such abuses not only harm the state budget but also erode trust in medical and social institutions. The increased accountability for both workers and medical professionals reflects the Polish government's intent to ensure honesty in this area, which could positively impact the overall efficiency of the healthcare system.
