Generator in the Apartment: Fines up to 3400 UAH and Criminal Liability
The use of gasoline and diesel generators in enclosed spaces in Ukraine is a serious violation that threatens not only with fines but also with criminal liability. According to current legislation, Article 270 of the Criminal Code of Ukraine provides for imprisonment of up to three years for using a generator in an enclosed space. If this leads to fatalities, the prison term can increase to eight years. Additionally, if death occurs as a result of carbon monoxide poisoning, Article 119 of the Criminal Code may apply. Families of victims or neighbors who witness the violation have the right to file a civil lawsuit for compensation, which can amount to hundreds of thousands or even millions of UAH.
It is important to note that generators are allowed to be used only outdoors, provided they are located at least five meters away from the building. This rule is aimed at reducing the risks associated with the use of such devices and preventing dangerous situations.
In the case of a violation, neighbors have a clear action plan:
- first of all, it is necessary to immediately call the police;
- then notify the homeowners' association or management company;
- and also report to the police with a statement.
This will allow for a prompt response to the situation and ensure the safety of residents.
