Slovakia's Prosecutor Reopens Inquiry into Transfer of MiG-29 Jets and Air Defense Systems to Ukraine

Прокуратура Словаччини відновлює розслідування щодо передачі літаків МиГ-29 та систем ППО для України.

Slovak General Prosecutor Resumes Investigation

The Slovak General Prosecutor’s Office has reinstated its probe into the supply of MiG-29 fighter jets and Kub air defense systems to Ukraine, citing gaps in the initial investigation. Maroš Žilinka, Slovakia’s General Prosecutor, announced on Facebook that the previous review failed to fully examine all relevant details or gather sufficient evidence regarding potential criminal conduct.

The regional prosecutor’s office in Trenčín has been tasked with reopening the criminal case and conducting a thorough pre-trial investigation. In November 2025, the Slovak prosecution had previously dropped the case, concluding there was no legal wrongdoing or abuse of power by government officials in the decision to provide military aid to Kyiv. The transfer did not cause harm to the Slovak Republic nor violate its Criminal Code.

Background on the Military Equipment Transfer

The Slovak government, led by Eduard Heger, approved sending MiG-29 jets to Ukraine in March 2023 under an intergovernmental agreement. On March 23, 2023, Slovakia delivered the first four MiG-29 fighters to Ukraine, with additional aircraft scheduled for later shipment. Former Slovak Defense Minister Jaroslav Naď is implicated in the case but has maintained that the previous government’s actions were lawful and free of criminal elements.

“During the preparatory proceedings, the factual circumstances required to make a decision—particularly regarding criminal elements—were not established.”

The decision to reopen this investigation suggests a need for a more comprehensive review to confirm the legality of Slovakia’s military support to Ukraine. This development could influence future defense collaborations between the two nations and spark further public debate about Slovakia’s role in supporting Ukraine amid the ongoing conflict.
