Procedure for Reassigning Personnel After Unauthorized Absence

The General Staff of the Armed Forces of Ukraine (AFU) has clarified the procedure for reassigning service members who have left their units without authorization, known as 'AWOL' (Absent Without Leave). When transferring personnel from reserve battalions, recommendation letters from combat brigades are considered, but documents from support units are not. Soldiers who go AWOL for the first time may avoid criminal liability under specific conditions. This policy comes amid ongoing challenges with troop morale and discipline during the prolonged conflict.

According to the General Staff, personnel who have gone AWOL are directed to priority staffing units. The AFU's staffing system is structured to prioritize the reinforcement of combat units. This means individuals who left their posts without permission can be reassigned to active-duty units if they are recommended by combat brigades.

Potential to Avoid Criminal Charges

Simultaneously, service members who are first-time offenders in going AWOL have an opportunity to be exempt from criminal prosecution. To qualify, they must voluntarily approach an investigator, prosecutor, or court with a request to return. After the court closes the criminal proceedings, the service member is obligated to report to their military unit within 72 hours.

According to the publication Glavcom, approximately 80% of conscripts flee from training centers. This situation is causing concern among military experts. Roman Kostenko notes that

'soon the number of AWOL cases will equal the size of our army'

, which could lead to adverse consequences for combat readiness.

Thus, the AFU General Staff is attempting to implement a system that allows for more effective resolution of personnel reassignments following unauthorized absence, taking recommendations into account and providing a path to avoid criminal liability for first-time offenders.
