Why Heating Companies Aren't Liable for Your Apartment's Temperature

According to Oleg Popenko, head of the Consumers of Utility Services Union, heating companies bear no legal responsibility for the temperature inside individual apartments under current Ukrainian law. A provider's liability ends at the point where the heating medium is delivered to the building's entrance. Internal heating issues, such as apartments being as cold as 14-15 degrees Celsius, are the responsibility of the building's co-owners. This legal division of responsibility often leaves residents frustrated during the winter months.

The heating company's control zone concludes at the building's entry point, meaning residents must address heating problems within their own apartments and building networks. Furthermore, the meters at a building's intake are often faulty or are simple water meters, which measure water volume rather than the actual heat energy delivered in gigacalories. This makes accurate billing and diagnostics of heat loss problematic.

The situation is exacerbated by the poor technical state of many buildings, which require major renovations. Popenko stressed that 'the monopolists, our ministries, have simply shrugged off the problem of poor-quality utility services in the form of heat supply to apartment buildings.' He emphasized that inadequate heating in apartments is ultimately the residents' responsibility, requiring them to insulate their homes. Laws regulating housing and utility services and commercial metering are not being enforced, leading to systemic heating failures.

The Complex Relationship Between Consumers and Providers

This scenario highlights the complex and often contentious relationship between consumers, heating suppliers, and building management structures in Ukraine. The lack of clear accountability for in-apartment heating results in resident dissatisfaction, as people pay for a service they do not receive at an adequate quality. The urgent need for building renovations and the widespread non-enforcement of utility legislation further worsen the crisis, demanding prompt resolution at the state policy level.
