Defense Lawyer Comments on Poroshenko’s Notification of Suspicion

Petro Poroshenko’s attorney, Igor Holovan, has called for a review of the suspicion notice issued against his client in the so-called 'coal case.' Holovan highlighted a precedent involving the notification sent to NABU Director Semen Kryvonos, which, despite being signed, was not properly delivered. Following the dismissal of Prosecutor General Ruslan Kravchenko, information about the suspicion against Kryvonos was removed from the Unified Register of Pre-Trial Investigations. Holovan suggests that a similar principle should be applied to Poroshenko’s case.

The suspicion against Poroshenko in the coal matter was signed by Deputy Prosecutor General Oleksiy Symonenko but was sent by mail rather than handed over in person. According to Holovan, the prosecution attempted to verify delivery by reviewing a video recording of Poroshenko’s lawyers’ briefing.

“The case of notifying NABU Director Semen Kryvonos demonstrates that merely signing the document without proper delivery does not complete the notification process.” – Igor Holovan

Background on the 'Rotterdam+' Case

Additionally, the Specialized Anti-Corruption Prosecutor’s Office (SAP) has closed the 'Rotterdam+' case four times due to lack of criminal evidence, on August 27, 2020, and again in January, March, and May 20, 2021. SAP’s conclusions indicate that the affected parties were Kolomoisky-owned plants rather than Ukraine itself.

Consequently, the legitimacy of Poroshenko’s suspicion status is becoming increasingly crucial amid ongoing legal proceedings and prior prosecutorial decisions.

Holovan’s statement underscores the critical importance of adhering to proper legal protocols in criminal cases, as procedural mistakes in delivering documents can significantly impact the validity of suspicions. This issue also reflects broader concerns about transparency and fairness within Ukraine’s judicial system, especially in politically sensitive cases like the coal investigation. The outcome may influence both the case’s trajectory and public confidence in the country’s justice system.

In light of the ongoing legal challenges surrounding Petro Poroshenko, it is important to consider related cases that highlight the complexities of judicial processes in Ukraine.
