Updates to Disability Functionality Assessment Regulations
The Cabinet of Ministers of Ukraine has introduced amendments to the resolution governing the evaluation of daily functioning for individuals with disabilities. These updates address the timeframes for disability determination, procedural accessibility, classification of disability causes, extensions of temporary incapacity, as well as the organization and appeal mechanisms for assessments.
Revised Framework for Disability Determination
Under the new regulations, Group I disability status can be assigned for a period ranging from 1 to 5 years or granted indefinitely during the initial assessment. The list of 97 anatomical defects and medical conditions qualifying for permanent disability status has been updated. Additionally, provisions now ensure continuity of disability status, preventing gaps between the expiration of one decision and the issuance of another when changing disability groups.
The amendments also expand the conditions eligible for remote evaluation and clarify grounds for conducting assessments at a person's place of residence or treatment. Procedures for Ukrainians abroad have been refined, including the option to involve sign language interpreters and accompanying persons. A unified directory aligning decisions from Medical-Legal Commissions and other relevant bodies with disability causes has been established, alongside the allowance for recording two disability causes simultaneously in specific cases.
- No assessment referral is required to extend temporary incapacity beyond 120 days.
- The attending physician now has authority to approve extensions of temporary incapacity without expert team recommendations.
- Commanding officers of military medical services have been granted authority to issue referrals in certain situations.
- The responsibilities of medical registrars and the capabilities of the electronic system have been expanded.
- Appeals can be reviewed in person, remotely, or via telemedicine platforms, according to the complainant's preference.
These legislative changes aim to streamline the process of obtaining disability status and enhance assessment procedures, which may significantly improve the quality of life for people with disabilities. They also reflect the government's commitment to modernizing the healthcare system and ensuring that medical services remain accessible to all citizens, including those living abroad.
