Ukraine’s Cabinet Sets 10-Day Deadline to Revise Criteria for Critical Enterprise Status Ahead of Inspections

Уряд України визначив десятиденний термін для оновлення вимог щодо статусу критично важливих підприємств перед проведенням перевірок.

Reevaluating the Criteria for Critical Enterprise Status

The Cabinet of Ministers of Ukraine has given ministries, government bodies, regional authorities, and Kyiv’s city administration a 10-day period to reassess the criteria that determine which companies qualify as critically important enterprises. Following this deadline, inspections will be conducted to verify whether these enterprises meet the updated standards. Notably, if a criterion that initially granted a company its critical status is removed, that status will be revoked.

Government Resolution No. 1328, adopted on October 23, outlines the conditions governing critical enterprise designations and the rules for reserving military personnel. Existing critical status decisions remain valid until their expiry date unless officially canceled. Additionally, Ministry of Defense reservations made before Resolution No. 1608 came into effect will be valid until December 8, 2026. Reservations issued after December 8, 2025, will remain effective within the timeframe set by the Ministry.

Establishment of the Coordination Center and Reservation Rules

The Cabinet has also established a Coordination Center tasked with managing military personnel reservation quotas. This center has the authority to deny reservation requests if enterprises violate regulations. Companies can reserve over 50% of their eligible military personnel based on recommendations from the Coordination Center. However, if a company’s leader has two or more documented violations of military registration rules or has faced administrative penalties within the past year, the center may refuse to consider their request.

Critical status can be granted to companies operating across various sectors, including:

  • defense industry
  • fuel and energy
  • housing and utilities
  • mining and processing
  • agriculture
  • retail trade
  • construction
  • transport and logistics
  • information technology
  • banking
  • healthcare
  • communications
  • emergency and rescue services

Upon justified request from the relevant government agency, the Coordination Center may approve additional sectors.

Enterprises involved in defense, energy, their contractors, and manufacturers of transformer equipment are eligible to reserve up to 95% of their military-eligible personnel. Exceeding this 95% threshold requires authorization from the Ministry of Defense or Ministry of Energy, following recommendations from the Coordination Center. For donor organizations and international technical assistance providers, reservation limits are capped at 50% per project and no more than seven individuals. Requests to exceed seven personnel but remain within 50% require approval from the Cabinet’s State Secretary, considering the Coordination Center’s advice.

The government advises companies to submit their applications for critical status well in advance to ensure timely processing.

These reforms reflect Ukraine’s heightened focus on safeguarding vital economic sectors amid ongoing conflict. By updating the critical enterprise criteria and instituting a centralized system to manage military personnel reservations, authorities aim to prevent misuse and prioritize strategic needs. This approach is designed to optimize resource allocation, supporting crucial industries that underpin national security and economic resilience during wartime.

As the Cabinet of Ministers implements these changes, the newly formed Coordination Center will play a crucial role in overseeing military personnel reservations. This development comes in light of the recent regulations for military bookings, ensuring that companies adhere to compliance standards while managing their reservation quotas effectively.
