On Monday, November 20, 2025, the Grand Chamber considered the case based on the constitutional submission of the Supreme Court regarding the impossibility of appealing the rulings of the investigating judge when it comes to the transfer of property for realization under the Criminal Procedural Code of Ukraine.
During the session, it was noted that the issue of the conformity of the articles of the Constitution of Ukraine and the Code, which limit the appeal against the rulings of the investigating court, requires detailed study. The court is considering arguments regarding the possible negative consequences for human rights associated with such limitations.
„The impossibility of appealing the rulings of the investigating judge may lead to serious problems for individuals involved in criminal proceedings, including loss of property,“ explained the reporting judge.
The court has already reached out to various organizations and institutions to obtain additional information and evidence. The results of the review are set to be announced at the closed part of the next session.
The ruling of the investigating judge and the possible consequences of limiting the appeal process are currently under the court's examination in the context of the importance of ensuring human rights in criminal cases in Ukraine.
