Contract with Control Process S.A. Terminated
The Lviv City Council has terminated its contract with the Polish contractor Control Process S.A. for the construction of a waste processing plant. This decisive action was taken due to the contractor's persistent failure to meet its obligations. The municipal enterprise Green City issued the formal notification of contract termination.
Signed in 2021, the agreement required Control Process S.A. to build Lviv's first modern waste processing facility, a commitment it ultimately failed to fulfill. Despite the city council approving an additional credit of 17 million euros in 2024, the contractor's performance did not improve, leaving the critical environmental project in limbo.
Chronic Failure to Deliver
The contractor failed to complete the project documentation and refused to hand it over to the client, Green City. Furthermore, Control Process S.A. did not deliver equipment partially funded by the Eastern Europe Energy Efficiency and Environment Partnership Fund. The firm also refused to perform specific contracted works and blocked access to the site for another contractor tasked with connecting the facility to the external power grid.
Oleksandr Yegorov, a representative of the Lviv City Council, stated: 'Due to the systematic failure of Control Process S.A. to meet its obligations, its non-compliance with the engineer's instructions, and its lack of response to related remarks, we have decided to terminate the agreement with this contractor.'
The termination will take effect on April 6, 2026.
This move highlights significant challenges in executing major infrastructure projects in Ukraine, which are crucial for meeting EU environmental standards. The plant is vital for reducing landfill waste and improving ecological conditions in western Ukraine. The council's decision to cut ties with the underperforming contractor may pave the way for engaging new, reliable partners to finally deliver this long-awaited facility, which remains a top priority for the city's environmental management.
