Customs to Gain Law Enforcement Powers: Marchenko Unveils Plans for a New Customs Code

New Version of the Customs Code Announced

Ukraine’s Finance Minister, Serhiy Marchenko, has announced that a revised Customs Code is being prepared, which would grant customs authorities law enforcement functions. The statement was made during a meeting of a temporary parliamentary investigative commission. This marks a significant shift in Ukraine’s approach to border enforcement, aiming to align with European Union practices.

On April 10, 2026, the Cabinet of Ministers of Ukraine appointed Orest Mandziy as the head of the State Customs Service. Mandziy was selected through an open competition that concluded at the end of March 2026.

Internal Audit at the State Customs Service

The State Customs Service has completed an internal audit concerning compliance with the law by officials at the Lviv Customs Office. The investigation focused on the import of consumer goods—such as clothing, footwear, and auto parts—through the Smilnytsia-Kroscienko and Krakovets-Korczowa border checkpoints. The period under review covers 2024 and the first quarter of 2025.

The preparation of a new Customs Code reflects the Ukrainian government’s ambition to reform customs policy and bring it in line with European standards. Granting law enforcement powers to customs authorities could fundamentally change how smuggling and other offenses in this sector are tackled. Additionally, the appointment of a new head of the State Customs Service may help drive these initiatives forward, as the new leadership aims to improve the performance of customs bodies and ensure legal compliance.
