Lifestyle Audits for Public Officials
A Lifestyle Audit (LSA) is a mechanism for verifying whether a public official's actual standard of living aligns with their declared income and assets. This process is initiated upon the receipt and confirmation of information indicating a discrepancy between an official's lifestyle and their declared wealth. Such an audit can lead to civil asset forfeiture or criminal prosecution. This system is a key component of Ukraine's anti-corruption framework, designed to enhance accountability in public service.
Civil Forfeiture and Criminal Liability
Civil forfeiture is governed by Article 290 of Ukraine's Civil Procedure Code. According to this provision, civil confiscation can be applied to assets acquired after November 28, 2019. For its implementation, the official subsistence minimum on that date, which was 2,007 UAH, is used as a benchmark. A lawsuit for civil forfeiture is filed when the discrepancy between a public official's assets and their lawful income exceeds 1,505,250 UAH.
Additionally, there is the possibility of criminal liability for illicit enrichment, regulated by Article 368-5 of Ukraine's Criminal Code. Criminal liability arises if the discrepancy between assets and lawful income exceeds 3,000 subsistence minimums, which for 2026 amounts to 9,984,000 UAH.
Grounds for initiating a Lifestyle Audit include expenditures on acquiring high-value assets such as real estate and automobiles, expensive travel, flights, vacations, as well as payments for education, hobbies, goods, and services that are inconsistent with official income. The actual use of high-value cars or real estate not listed in a declaration can also trigger an investigation.
To substantiate claims, various forms of evidence may be used, including photos, videos, insurance policies, and powers of attorney. The consequences of an LSA can be civil forfeiture, which involves the seizure of unjustified assets for the state's benefit without proving a criminal offense, or criminal liability, which entails an investigation into potential illicit enrichment.
