Former Ukrainian Prosecutors Charged in $100,000 Bribery Scheme

Former Prosecutors Face Corruption Charges

Ukraine's National Anti-Corruption Bureau (NABU) and the Specialized Anti-Corruption Prosecutor's Office (SAP) have formally charged former senior prosecutors from the Ivano-Frankivsk Regional Prosecutor's Office. The officials are accused of soliciting and accepting illegal benefits in exchange for terminating criminal proceedings and shielding individuals from prosecution. Investigators have identified two distinct episodes of criminal activity occurring between 2019 and 2021.

The suspects, including the former head of the regional prosecutor's office and a former department chief, allegedly demanded bribes from companies in return for not prosecuting their employees and for closing criminal cases. In 2021, the prosecutors specifically demanded a $100,000 payment. In exchange, they agreed to make decisions favorable to officials of a state-owned enterprise and a private company that had acquired the enterprise's assets. The criminal case was closed shortly after the funds were received.

Legal Classification of the Crimes

The first criminal episode is classified under Part 4 of Article 368 of Ukraine's Criminal Code. During 2019-2021, a company entered into contracts worth hundreds of millions of hryvnias, for which the prosecutors demanded a 3% kickback from the contract value. The perpetrators received a portion of this sum in November-December 2021. The second episode is classified under Part 3 of Article 368. The investigation is ongoing, with NABU having already charged four individuals as part of a broader criminal organization case allegedly led by a former head of Ukraine's State Property Fund.

This case highlights the persistent challenges of corruption within Ukraine's judicial and law enforcement systems, a key focus of the country's reform agenda. The prosecution of high-ranking officials for bribery demonstrates the ongoing, though difficult, efforts to establish accountability. Such cases are critical for rebuilding public trust and advancing judicial reforms that are essential for Ukraine's future.
