The Rights of Ukrainian Citizens Regarding Military Registration
Ukrainian citizens who have been officially deemed unfit for military service have the right to be removed from the military register. However, as recent cases demonstrate, Territorial Recruitment Centers (TRCs) sometimes illegally reinstate such individuals onto the register. If this occurs, specific steps must be taken to overturn the recruitment office's unlawful decision. This issue has gained prominence during a period of heightened national mobilization.
Procedure for Challenging a TRC Decision
The first step is to send an official demand to the TRC via registered mail with a list of enclosed items. As Vladyslav Derii advises,
"You must send a statement to the TRC by registered mail with an inventory, demanding they enter information about your removal from the register into the Oberih Register. A copy of your paper military registration document must be attached to the statement."If the recruitment office fails to make the appropriate changes within five working days of receiving this letter, citizens have the right to challenge this inaction in court.
In such cases, courts overwhelmingly rule in favor of the plaintiffs. With properly prepared documentation, courts typically grant the claims and annul the TRCs' illegal decisions. Viacheslav Kyryda emphasizes:
"I want to note right away that you should still be prepared to go to court. As practice shows, TRCs do not voluntarily make these changes as often as we would like."Therefore, citizens who believe their rights have been violated can seek justice through the courts if their demands are not met during pre-trial proceedings.
This situation underscores the critical importance of protecting citizens' rights in military matters, especially under current circumstances. Although the law provides certain guarantees for those declared unfit for service, practical cases show that citizens themselves must take active steps to defend their rights. The prevailing court practice, which favors plaintiffs, serves as a crucial tool for protection against unlawful TRC decisions.
