Artificial Intelligence in Migration Administration: Germany's New Legal Framework

Germany, which handles a high number of asylum claims each year, has taken a step toward digitalizing its migration system. The federal cabinet approved a bill that creates a legal basis for using artificial intelligence in migration offices and during asylum procedures. As the federal government stated,

The purpose of the AI in migration administration law is to make asylum and residency procedures more efficient, standardized, high-quality, and secure.
The government also emphasized that
This will allow applications to be processed more quickly and decisions to be reached more easily.
However, individual assessments and final decisions remain the responsibility of human staff.

Technology's New Role in Migration Policy

Under the new provisions, authorities can use personal data collected during application processing for asylum and residence permits to develop AI systems and other automated tools. These AI systems will analyze procedural flows and decision-making patterns, which is expected to accelerate application handling. In cases where there are reasonable doubts about accuracy, the AI may cross-check data against publicly available online sources.

This approval reflects Germany’s effort to align its migration policies with modern technological developments, potentially significantly impacting the speed and quality of asylum application processing. At the same time, the use of AI raises concerns about data protection and ethics, as a balance between procedural efficiency and individual rights must be maintained. In the future, this legislation could serve as a model for other nations considering the adoption of technology in migration management.
