A New Legal Tactic to Pressure the Pension Fund

Ivan Khomych's law firm has pioneered a new legal strategy to pressure Ukraine's Pension Fund, leveraging Article 382 of the Code of Administrative Procedure. This article allows for judicial oversight of court decision enforcement. The firm has already secured initial rulings from judges that confirm the effectiveness of this novel approach.

This mechanism is applied specifically when the Pension Fund fails to properly implement a court's decision. In such cases, a pensioner can petition the court that originally heard their case to establish judicial oversight. The court then orders the Pension Fund to submit a report and explanation for its non-compliance. This is particularly significant in light of Decree 821, which restricts pension payments mandated by court rulings. This legal environment often leaves pensioners struggling to receive court-ordered entitlements.

Attorney Tetiana Holytsia noted: 'We are already putting this method of appeal into practice. We have literally just received the first judicial rulings where courts are specifically ordering pension funds to provide a report on the execution of the court decision.'

She also stressed the importance of taking action: 'You have to fight; you must not give up.' This new mechanism could become a vital tool for protecting pensioners' rights.
