Lump-Sum Aid for Families of Deceased Military Personnel

In Ukraine, a crucial form of social security for the families of fallen soldiers is a one-time financial payment. The amount of this aid is not fixed; it is determined by the specific circumstances surrounding the service member's death. The payment varies significantly depending on whether the death occurred in the line of duty or resulted from an illness or accident. A key requirement for receiving any aid is an official investigation report that confirms a direct link between the death and the period of active military service.

Concerns arose in one case where the family of a deceased soldier consulted legal experts after noticing a reference to Article 14 of the 'On Labor Protection' Law in the death documentation. However, this citation pertains solely to the procedural rules for investigating an incident and does not, in itself, disqualify a family from receiving military death benefits. The decisive factor for the payment is whether the official investigation findings confirm a causal link between the death and the performance of military duties.

“The mention of Article 14 of the 'On Labor Protection' Law in your case files typically refers to the procedure for investigating the incident. By itself, it does not 'remove' the family's right to the military lump-sum payment. The key is the causal connection to the performance of service duties, which is documented in the official investigation reports and conclusions.”

Determining the Payment Amount

The payment structure is defined by law. If a service member dies while performing military duties—even if not in a combat zone but while on assignment—the family receives 2,271,000 UAH. This sum is equivalent to 750 times the official subsistence minimum. In cases where death occurs during service due to illness or an accident, the payment is 1,514,000 UAH, which corresponds to 500 subsistence minimums.

Therefore, the final amount of the one-time aid to families of fallen soldiers hinges entirely on the confirmed circumstances of death and the proven causal connection to military service obligations.

This situation underscores the critical importance of a clear legal framework and proper procedures in providing social support to the families of deceased service members. Correct documentation and obtaining official investigation conclusions play a decisive role in establishing eligibility for financial assistance. It is also vital for bereaved families to be aware of their rights and the process to avoid legal complications when applying for these benefits. These payments are part of the state's support system for those who have lost loved ones in defense of the country.
