Ombudsman on TCC: the military has no right to check your documents

Ombudsman's statement on citizens' rights

Commissioner of the Verkhovna Rada for Human Rights Dmytro Lubinets stated that the military of the territorial recruitment centers (TCC) do not have the right to check citizens' documents and restrict their rights. According to Lubinets, these functions should be performed only by law enforcement agencies, such as the National Police, the State Border Guard Service of Ukraine (DPSU), and the National Guard.

Problems with control

Lubinets also noted that body cameras used in TCC for recording events do not always work or are absent in the most problematic situations. This, in the opinion of the ombudsman, indicates possible violations of citizens' rights. He pointed out that representatives of his office sometimes record such violations, however, people often do not follow legal procedures, for example, they do not contact the TCC to resolve their issues.

These statements of the ombudsman emphasize the importance of respecting human rights in times of war, when control over the implementation of legislation becomes particularly relevant. Calls for clearer delineation of powers between the military and law enforcement agencies may influence policy formation in this sphere and ensure proper enforcement of legal norms.
