The State of Pension Payments in Ukraine
In January 2026, thousands of Ukrainian pensioners did not receive court-mandated supplements to their pensions. The delay was caused by Cabinet of Ministers Resolution No. 821, which permits the Pension Fund of Ukraine (PFU) to disburse such recalculated funds only if corresponding financing is available. This situation highlights the ongoing tension between judicial rulings and government budget execution. Consequently, all retirees who had successfully won their court cases were left without the payments legally owed to them.
The Pension Fund of Ukraine's budget for 2026 is set at 1.263 trillion hryvnias, an increase of 240 billion hryvnias from the previous year. Over one trillion hryvnias is allocated for pension payments. Despite these substantial figures, the implementation of court decisions regarding supplementary payments has been jeopardized by the new budgetary restrictions.
Legal Challenge Against Resolution No. 821
The legal firm 'Legal Network' has initiated proceedings to challenge Resolution No. 821. Court hearings on the appeal are scheduled in Kyiv for February 12, 18, 19, and 25. Dmytro Korsun, a representative of the legal firm, stated that
"this is a direct consequence of decisions made by the Pension Fund and the Cabinet of Ministers,"emphasizing that
"none of the pensioners who went through court proceedings received the recalculated supplements."
Korsun further stressed that 'a court decision cannot be executed "partially," "when funds become available," or "within budget limits."' He argues that 'restricting the actual payment of a court-determined pension is a direct violation of a pensioner's property rights.' The lawyers' position underscores the critical importance of protecting pensioners' rights, as 'this is not a story about "waiting," it is a story about defending a right.'
