Tax Exemptions for Energy Equipment Imports Extended

The State Customs Service of Ukraine has announced an extension of tax exemptions for importing critical energy equipment, now valid until January 1, 2029. This strategic move is designed to bolster the nation's energy sector and was enacted through new Ukrainian Laws No. 4698-IX and No. 4710-IX. This policy is part of broader efforts to strengthen energy resilience following widespread infrastructure attacks.

Eligibility and Restrictions for Duty-Free Imports

Both businesses and private citizens have the right to import eligible equipment without paying customs duties (exemption code 245). The benefit applies to goods brought in personally as well as those shipped via postal or express delivery services. The list of qualifying energy equipment includes:

  • Electric generating sets with piston engines exceeding 7.5 kVA in power;
  • All types of lithium-ion batteries, including lithium-cobalt, lithium-iron-phosphate, lithium-manganese-oxide, and lithium-nickel-manganese-cobalt-oxide.

However, the preferential regime does not apply to goods originating from the aggressor country or imported from its territory. Customs clearance for items not covered by the exemption proceeds under standard procedures with full payment of all applicable duties. Specifically, the following categories of goods are excluded from the tax break:

  • Low-power generators (less than 7.5 kVA);
  • Small charging stations and power banks with a capacity under 300 W.

Extending these tax breaks on critical energy imports is a vital step for supporting Ukraine's energy independence, particularly amid ongoing challenges. The decision aims to stimulate investment in renewable energy sources and improve energy infrastructure, which is increasingly urgent given rising energy demands. Simultaneously, the ban on imports from the aggressor nation underscores Ukraine's commitment to reducing dependency on external risks and ensuring national security within the energy sector.
