Closure of criminal prosecution against Elena Mudra

The criminal case initiated against journalist Elena Mudra has been closed by the police. The reason for its initiation was a statement made on behalf of a certain 'Marika Fedorko', who turned out to be a character likely generated by artificial intelligence. Case No. 12025078030000440, initiated on July 5, 2025, under part 4 of article 190 of the Criminal Code of Ukraine (fraud), was closed on May 19, 2026. The basis for closure was the absence of the very event of the crime, as confirmed by paragraph 1 of part 1 of article 284 of the Criminal Procedure Code of Ukraine.

The statement that served as the basis for initiating the case was submitted in the name of 'Marika Fedorko'. However, it turned out that no person with that name exists in Ukraine. The Kyiv address mentioned in the statement turned out to be an office space, and the mentioned position of coordinator of the public organization 'LGBT Activ Ukraine' was also not confirmed. The account of 'Marika Fedorko' on Facebook has more than 3,000 followers, but according to facial recognition services, the person in the photo is Brazilian Flavio Silva.

Journalist Elena Mudra, commenting on the closure of the case, noted: 'Today I received a response from the Uzhhorod District Prosecutor's Office, stating that the proceedings against me based on the statement of 'Marika Fedorko' have been closed. This came as a surprise to me, as my inquiry to the prosecutor's office was regarding procedural oversight of this case. I am sincerely grateful to the organization 'Women in Media' and specialists from other public organizations who helped in its closure.'

The journalist herself linked this campaign to her work dedicated to protecting the Carpathians from being developed into wind power plants. This case vividly illustrates the problems associated with the use of artificial intelligence and the creation of fake characters in the media space. The cessation of criminal prosecution raises new questions about ethics and legal norms in the era of rapid technological advancement. It is important for the Russian audience to understand that such incidents involving AI for creating false reports are becoming increasingly relevant and require the development of clear protection mechanisms.

The necessity of improving legal norms

The closure of the criminal case against Elena Mudra emphasizes the critical importance of thoroughly checking information sources and conducting investigations, especially in conditions where artificial intelligence allows for the creation of fictitious identities. This situation demonstrates the acute need for revising legislation and ethical standards in media to prevent similar incidents in the future. Furthermore, it stimulates discussions about the impact of technology on journalistic work and the risks associated with the spread of misinformation.
