The Cabinet of Ministers of Ukraine has established new, stricter requirements for enterprises regarding military registration and mobilization notification in conditions of martial law. According to the government resolution, all employers are now obliged not only to keep records of conscripts, reservists, and military-registered employees but also to ensure the delivery of summonses at the request of territorial recruitment centers and social support, the Security Service of Ukraine, or intelligence agencies.
Notification and delivery of summonses
In case of receiving an order from state bodies, the head of the enterprise is obliged to issue an order for the delivery of summonses, which is executed by an authorized employee. This person is responsible for delivering documents for clarifying accounting data, undergoing a military medical commission, or fulfilling a mobilization order under the personal signature of the employee.
According to the new requirements, within three calendar days after notification, the employer must submit a written report to the military recruitment center, confirm the fact of executing the order and provide information about the employee's arrival upon summons. In case the employee refuses to receive the summons or terminates employment, the company must immediately notify the appropriate territorial center.
Notification of remote workers
A separate procedure for delivering summonses to employees working remotely is provided. In these cases, notification must be sent by registered mail with acknowledgment of receipt and a description of the attachments.
The employer is also obliged to issue an internal order for notification, send a copy of this document to the employee by mail, and keep all accompanying documents, including evidence of remote work format. All these materials must be submitted to the military recruitment center within three calendar days.
