Guidelines for Installing Fences in Ukraine

In Ukraine, erecting fences around private or garden plots is governed by Cabinet of Ministers Resolution No. 406 dated June 7, 2017. This regulation eliminates the requirement for permits or construction passports. However, property owners are responsible for complying with specific standards regarding fence height, boundaries, and materials. Failure to follow these rules can result in fines and legal consequences.

The maximum allowed height for fences between neighboring yards is 2 meters, while fences facing the street can be up to 2.5 meters tall. Solid fences must not block a neighbor’s access to sunlight and fresh air. Electric fences require certification before installation, and using materials like barbed wire or glass can lead to criminal liability if they cause injuries.

Even a minor encroachment—such as a fence extending 10 centimeters beyond the property line—can be detected through satellite monitoring and may trigger a fine. Penalties for violating beautification regulations range from 340 to 1360 hryvnias, while unauthorized land use incurs fines between 170 and 850 hryvnias.

Irina Polyakova, an expert in land law, warns: "If your fence crosses the shared boundary by even 10 centimeters, the system will notice it, and a fine can be issued easily, even without an inspector visiting your property."

When neighbors mutually agree to place a fence directly on a shared boundary, the fence becomes jointly owned and requires cooperative maintenance. If the fence is built without the neighbor’s consent, it must remain entirely within the owner’s property and is solely their responsibility. Costs for boundary markers and basic fencing materials are typically split equally between neighbors.

If disputes arise, property boundaries can be officially determined by summoning a land surveyor who will mark the borders on-site. The legal boundary report produced serves as the primary evidence in conflicts.

Required Distances from Property Boundaries

It is crucial to respect setback distances from property lines. Residential buildings must be situated at least 3 meters away from the boundary, sheds at 1 meter, bushes at 1 meter, and trees between 4 to 6 meters depending on their canopy size. Notification of neighbors regarding boundaries can be done via registered mail, and their signature on official documents is not mandatory.

When neighbors cannot reach an agreement on fence placement, court intervention may be necessary. According to Irina Polyakova, "Only a court can compel a neighbor to remove or relocate a fence." Unauthorized removal of someone else’s fence is considered a criminal offense under Articles 194 and 356 of the Criminal Code.

The cost to have boundaries professionally surveyed for a typical residential plot ranges from approximately 2500 to 3500 hryvnias, depending on the number of points, plot size, and urgency. In cases lacking official boundary documents, borders are established based on actual land use or the disputed area is divided equally.

Overall, private and garden plot owners in Ukraine must carefully observe fencing regulations to avoid fines and legal disputes. Understanding and following these rules are essential to prevent conflicts and ensure smooth property relations.
