Right to judicial protection in labor disputes: The court is considering the case based on the constitutional complaint of Oleg Timoshenko


On November 26, 2025, the Senate held a plenary session to consider the case based on the constitutional complaint of Oleg Timoshenko.


During the session, the reporting judge Alla Oliynyk presented the essence of the complaint and the applicant's justification.


It is reported that Timoshenko applied to the Constitutional Court to verify the constitutionality of certain provisions of labor laws. The court ruling deprived him of the opportunity for judicial protection. Timoshenko filed a constitutional complaint, believing that this situation violates his rights.

Oleg Timoshenko filed a lawsuit against the company 'Insurance Group TAS'. The court rejected his claim, and after that, he submitted a constitutional complaint.


The basis for the complaint is that he was unable to go to court due to statutory deadlines in labor law.


Timoshenko argues that this violates his rights under the Constitution of Ukraine.



Case Examination


The Senate conducted a thorough analysis of the materials and moved to the closed part of the session.


Also present at the meeting was a representative of the Verkhovna Rada of Ukraine, Maxim Dirdin.

During the plenary session, the court is considering the constitutional complaint of Oleg Timoshenko, who was deprived of the opportunity for judicial protection in a labor dispute. Timoshenko believes that the deadline limitations violate his constitutional rights. The court is examining all the circumstances of the case to make a further decision on this issue.
