Kyiv City Prosecutor's Office Files Lawsuit

The Kyiv City Prosecutor's Office has filed a lawsuit demanding the return of illegally occupied land, the demolition of an unauthorized restaurant built on it, and the cancellation of the property's ownership registration. The case concerns a plot of land valued at over 8 million hryvnias, covering an area of 1 hectare. This land is situated on Naberezhno-Korchuvata Street in Kyiv's Holosiivskyi District, within the protected coastal zone of the Dnipro River's 'Galerna' inlet. The legal action highlights ongoing efforts in Ukraine to reclaim public land and enforce environmental protections.

Investigations have established that in 2014, the ownership of a non-residential premises spanning 156.5 square meters was unlawfully registered. This registration was based on a certificate that was never officially issued, which subsequently allowed the property to be sold. It is important to note that the Kyiv City Council never approved any decision to transfer this land plot. The Kyiv City Commercial Court has now initiated proceedings in the case, based on information provided by the press service of the Kyiv City Prosecutor's Office.

Significance of the Case

This case is crucial for upholding the rule of law regarding land use, particularly in environmentally sensitive areas. It also underscores the persistent problem of fraudulent property registrations, which can lead to abuses and legal violations. The court's final ruling will set a significant precedent, not only for the parties directly involved but also for deterring similar illegal constructions in the future.
