Return of the premises to the university
The prosecutor's office returned the premises of the Ukrainian State University named after Mykhailo Dragomanov from lease, which had been transferred for a restaurant in violation of current legislation. According to information, the lease agreement was concluded between the university and an economic entity, and the area of non-residential premises amounted to more than 152 sq.m. The rental cost was almost 9 million hryvnias.
The premises, which became the subject of return, are located on the first floor of the central building of the university on Ivan Franko Street in the Shevchenkivskyi district of Kyiv. The tenants arranged a restaurant there, which is a violation of the Law of Ukraine 'On Education', which prohibits the use of property of state and municipal educational institutions for purposes not related to education.
Actions of the prosecutor's office and the court
Juvenile prosecutors of the Kyiv City Prosecutor's Office appealed to the Economic Court of Kyiv with a lawsuit to declare the lease agreement invalid. The court supported the prosecutor's position, and the court's decision was fully implemented. Thus, the premises were returned to the university, which indicates compliance with educational legislation.
