The government of Ukraine has made a decision regarding changes to Resolution No. 909, which concerns the procedure for conducting concession competitions. These changes will come into effect on January 1, 2027. The update is an important step towards compliance with the Public-Private Partnership Law, which stipulates the conduct of competitions and competitive dialogue through the single trading system Prozorro.
To fully implement the law, it will be necessary to develop and adopt 30 subordinate regulatory acts. However, for projects that began before the law was adopted, the parliament has allowed the completion of ongoing procedures under the previous rules.
The Ministry of Economy emphasizes that even under the conditions of temporary postponement of the application of Prozorro, all concession competitions are conducted in accordance with the legislation, disclose information in accordance with the Law on Access to Public Information, and are subject to control.
The changes to Resolution No. 909 that the government of Ukraine has adopted aim to improve the procedures for conducting concession competitions and ensure compliance with the requirements of legislation in the field of public-private partnership. Supporting Prozorro and maintaining transparent and competitive conditions in the market is a priority task for ensuring the development of the partnership between the state and business.
