United States Imposes Sanctions on the International Criminal Court as Ukraine Joins in 2025

US Sanctions Target International Criminal Court

On October 9, the administration of then-President Donald Trump announced new sanctions against the International Criminal Court (ICC). These measures aim to restrict the court’s access to resources and prohibit cooperation with it. US Secretary of State Marco Rubio emphasized that the United States will not allow the ICC to prosecute American citizens. The sanctions also threaten companies that provide services directly to the ICC.

Rubio stressed that these sanctions are intended to pressure the court and its member states to consider the US position. Addressing America’s allies who are ICC members, he warned:

“Either the ICC ceases its threats, or we will bring an end to the ICC. We expect our allies, many of whom rely on US military support for their defense, to keep the court in check.” - Marco Rubio

He added that if these efforts fail, the US will continue to take further action.

ICC Responds to US Sanctions

In response, ICC Deputy Prosecutor Fatou Bensouda condemned the sanctions, calling them an attack on the rule of law at the international level and on the work of an independent judicial body. She affirmed that the court will persist with all investigations and prosecutions despite the sanctions, declaring that such punitive measures must be rejected.

This confrontation unfolds as Ukraine is set to become the ICC’s 125th member state on January 1, 2025. In October 2024, Ukrainian officials Iryna Mudra and Sergiy Kyslytsia officially deposited Ukraine’s ratification of the Rome Statute, the treaty establishing the ICC. It is worth noting that the Trump administration had previously targeted ICC prosecutors and judges with restrictions, and in August 2026, sanctions were imposed on ICC President Tomoko Akane of Japan and senior judge Abdoulaye Sey of Senegal.

The US sanctions highlight growing tensions between Washington and international justice institutions, reflecting how domestic US politics can directly impact global legal cooperation. As Ukraine steps up its engagement with the ICC, these sanctions may have significant implications for international legal proceedings and collaboration on human rights and accountability for serious crimes worldwide.
