Kyiv Prosecutor Sues Developer for $8 Million Unpaid City Fee

Київська прокуратура подала позов проти забудовника через несплату міських зборів на суму 8 мільйонів доларів.

Kyiv Prosecutor Files Lawsuit Against Developer

The Kyiv City Prosecutor's Office has initiated a lawsuit in the Kyiv Commercial Court against a development company. The suit demands payment of over 8 million hryvnias in unpaid mandatory contributions to the city budget, related to the construction of a residential complex in the Obolon district. The court has already opened proceedings in this case. This action highlights ongoing efforts to enforce financial obligations from real estate developers to the municipal government.

Construction Details and Legal Changes

The construction project, located on Mykola Yunkerov Street, involved the building of low-rise residential buildings with a total area exceeding 16,000 square meters. While the mandatory developer contribution scheme was abolished in Ukraine as of January 1, 2021, the law still requires developers to settle any fees that became due before that date. This case is part of a broader pattern of increased oversight in the urban development sector.

The Kyiv Commercial Court will now hear the case, underscoring the importance of developers fulfilling their financial commitments to the city. The enforcement of such obligations is critical for the city's financial stability and its ability to fund public infrastructure. The outcome of this lawsuit could set a significant precedent for other developers who may have similar outstanding liabilities from projects initiated before the 2021 legal change.
