Penalties for Military Registration Offenses
Ukraine's Territorial Recruitment Centers (TRCs) are actively imposing fines on company officials for violations of military registration rules. The fines range from 34,000 to 59,500 hryvnias. Specific individuals are held accountable for these infractions, including company directors or employees responsible for maintaining military records. This enforcement drive is part of broader mobilization and legal compliance efforts during wartime.
The final fine amount is determined by the head of the TRC during case proceedings. It is important to note that there are statutes of limitations for prosecution: three months from the discovery of the violation, but no later than one year from its commission, according to Article 38 of Ukraine's Code of Administrative Offenses. If an employee was hired without notifying the TRC over a year ago, the TRC loses the right to fine them.
Individuals Liable for Military Registration
According to expert opinion, the liable individuals in such cases are:
- The enterprise director,
- The employee responsible for military registration,
- A human resources officer,
- An accountant.
