Lawyer Outlines Two Key Grounds for Challenging Ukrainian Military Draft Fines

Lawyer Rostyslav Kravets has reported successful legal challenges against fines issued by Territorial Recruitment Centers (TRCs) in Ukrainian courts. He highlighted two primary legal grounds for having such penalties overturned. Importantly, Kravets emphasized that these fines can be contested from anywhere, including from abroad.

Speaking on the YouTube channel 'Law in Ukraine', the attorney explained that a frequent issue is the lack of evidence proving a draft summons was actually sent.

“Very often, such data does not exist. It is absent from the TRCs, the proof that they sent the summons,” Kravets noted.

Grounds for Overturning the Fines

The first basis for cancellation is the absence of proof that a summons was mailed. The second ground is that the violation protocol was reviewed without the individual's participation and without notifying them.

“The protocol must be reviewed with the person's participation, and they must be notified about the review of the protocol concerning them. In our practice, no one does this, and this is an unconditional basis for canceling a TRC fine,” the lawyer added.

Kravets also confirmed that “whether you are in Ukraine or abroad—these fines can be challenged, accounts can be unblocked, and this money can be returned.” Judges have the authority to cancel the fines and to award court fees and legal costs in favor of the claimant. This legal process is particularly relevant for the many Ukrainians currently residing outside the country due to the ongoing war.
