How to Pay 8,500 Instead of 17,000 Hryvnias for Mobilization Violations

Ukrainian lawyer Tetiana Kozian has detailed the process for handling fines related to mobilization rules. Under current law, penalties for such violations start at 17,000 hryvnias. However, starting in the summer of 2025, citizens will be able to reduce this amount by 50% using the 'Reserve+' application. This digital tool is part of a broader government effort to modernize administrative procedures. If a violation is processed through 'Reserve+', the Territorial Recruitment Center (TCC) will issue a ruling within three days, allowing the individual to pay a reduced fine of 8,500 hryvnias within a 20-day window.

Should the citizen fail to pay within this initial 20-day period, the fine reverts to the original 17,000 hryvnias. Furthermore, if payment continues to be ignored for an additional 20 days, the penalty doubles to 34,000 hryvnias. At that point, the case is transferred to the state enforcement service for collection.

Legal Consequences of Unpaid Fines

Kozian also clarified that existing legislation does not permit the TCC to directly confiscate property solely for non-payment of a fine. Asset seizure requires a separate court order. She emphasized that:

'If fines accumulate and remain unpaid, they can be enforced through the courts. In such a case, a judge may authorize measures to recover the funds, including the seizure of property or freezing of bank accounts.'

She added that 'systematic non-payment of fines does not in itself trigger automatic asset forfeiture, but it creates significant legal risks once the matter goes before a judge.' Therefore, the new 'Reserve+' app provides a convenient mechanism for mitigating penalties and ensuring timely payment of fines arising from mobilization rule violations.

The introduction of 'Reserve+' aims to streamline the management of fines and sanctions, potentially reducing the burden on the court system and enabling more efficient enforcement. It is crucial for citizens to understand their obligations and the escalating financial consequences of non-payment to avoid severe hardship.
