Court Returns Land Worth UAH 167 Million to Ukraine’s National Academy of Sciences

Kyiv Construction Disputes Resolved in Court

Prosecutors successfully invalidated an investment agreement for developing a plot owned by a National Academy of Sciences of Ukraine (NASU) institute in Kyiv’s Sviatoshyn district. The Commercial Court of Kyiv upheld a lawsuit filed by the Sviatoshyn District Prosecutor’s Office, targeting a contract that envisioned construction on an 8.14-hectare parcel. This land, valued at over UAH 167 million, is currently used by the I.M. Frantsevich Institute for Problems of Materials Science, part of NASU.

Located on Omelyan Pritsak Street in Sviatoshyn, the plot was subject to a deal between the institute and a limited liability company to build a multipurpose complex. Investigators found that the private firm attempted to claim ownership of property on state-owned land without approval from the Kyiv City State Administration.

Additional Cases of Unauthorized Construction

Separately, in Kyiv’s Desnianskyi district, authorities launched a case over illegal construction. A two-story building spanning nearly 2,000 square meters sits on a 0.12-hectare municipal plot, now used by a private legal entity, without proper authorization.

The Dnipro District Prosecutor’s Office of Kyiv also filed a claim to reclaim non-residential premises at 24/7 Instytutska Street from unlawful private ownership. These premises, valued at over UAH 13 million, have been part of the city’s communal property since a 2001 Kyiv City Council decision. Since 2014, they were leased by the Main Department of the National Police in Kyiv.

Finally, the Kyiv City Prosecutor’s Office secured a Supreme Court ruling to revoke a construction permit for a residential complex on a plot in the Holosiivskyi district. That site contains a water tower designated as a cultural heritage object, underscoring the importance of preserving the capital’s historical legacy.

These developments highlight intensified efforts by prosecutors to safeguard state and municipal assets in Kyiv.

Invalidating the investment agreement and canceling building permits are part of broader measures to prevent unauthorized constructions that could threaten cultural heritage and the environment. Such rulings also underscore the critical need for strict oversight of urban development laws—a pressing issue for Ukraine’s capital amid rapid construction growth.
