Kyiv Court Rules Against Government Pension Policy
On February 10, 2026, the Kyiv District Administrative Court issued a ruling that invalidated a key provision of a government decree. The provision had reduced the pension indexation coefficient for individuals who retired between 2021 and 2024. The court specifically struck down part of Cabinet of Ministers Resolution No. 209, dated February 25, 2025, which had set a general pension increase coefficient of 1.115 (or 11.5%). This ruling is a significant development in Ukraine's ongoing efforts to balance fiscal policy with social protections for its aging population.
Core of the Legal Dispute
The legal challenge centered on clause 6, part 2 of Resolution No. 209. This clause created an exception, applying a reduced indexation coefficient based on the exact year a person retired. For instance, under this mechanism, a retiree from 2024 who expected a 900 hryvnia increase received only 350 hryvnia instead. The court deemed this clause unlawful and void, creating grounds for the recalculation of pension payments for hundreds of thousands of Ukrainians whose pensions were awarded under Law No. 1058-IV during the 2021–2024 period. The ruling in favor of the pensioner (case No. 320/14123/25) is not yet legally binding, as the Cabinet of Ministers retains the right to file an appeal.

This court decision is crucial for retirees from the specified period, as it could lead to a substantial boost in their monthly payments.
