Ukrainian Court Rules on Compensation from Russia

A Ukrainian court has issued a default judgment ordering the Russian Federation to pay compensation to the family of a couple killed in a Russian attack. This ruling addresses the moral and material damages inflicted upon the Korolkov family, who died on March 22, 2024. This case is part of a broader legal effort to hold Russia accountable for wartime damages through Ukrainian civil courts.

The court mandated that Russia make the payment after the cessation of hostilities. It awarded 25 million hryvnias in moral and material damages to Oksana Anatoliivna Korolkova and a further 25 million hryvnias to Yevhen Anatoliiovych Korolkov.

Oleksandr Uroda, the family's lawyer: 'We filed a lawsuit against the Russian Federation to claim moral and material damages. My clients were Ms. Oksana, and in a separate case, her husband Yevhen.'

Challenges in Using a State Housing Certificate

The Korolkov family received a state certificate for housing, but they have faced significant difficulties in actually using it. Oksana Korolkova noted: 'We got the certificate, but it's not easy to use. Sellers are often reluctant to deal with state payments.' The family's home was nearly destroyed, forcing them to rent accommodation for two years.

According to their lawyer, legal action against Russia is only possible after receiving Ukrainian state aid, and it requires gathering comprehensive evidence.

Oleksandr Uroda added: 'Yes, they can file claims where the defendant is the Russian Federation. All evidence must be collected: photos, videos, witnesses. If there is a strike, a criminal case is always opened on that fact; one must contact the investigator and gather all possible evidence.'

Thus, the court's decision marks a significant step in securing the rights of a family that suffered losses due to aggression. It establishes a potential legal pathway for other victims to seek compensation, highlighting both the responsibility of the Russian Federation for damages and the importance of legal mechanisms to protect victims' rights during war.
