Court Seizes Land Valued at 32 Million UAH from Private Firm for Lease Violations

Судові органи конфіскували земельну ділянку, оцінену у 32 мільйони гривень, у приватної компанії через порушення умов оренди.

Kyiv Economic Court Ruling

The Kyiv Economic Court has ordered a private company to return a plot of land to the community for violating its lease agreement. The ruling came in response to a lawsuit filed by the Solomiansky District Prosecutor's Office. As a result, the enterprise must hand back a nearly 0.7-hectare plot, located on Liudmyla Protsenko Street, to the city's territorial community. The estimated value of this land is 32 million Ukrainian hryvnias (UAH).

The land was originally leased to the company in 2006, but the firm consistently failed to pay the required lease fees. Furthermore, the plot is situated in an area deemed at risk of landslides. Due to these violations, the court mandated the land's return to the community. This case highlights the ongoing efforts by Ukrainian authorities to enforce land-use regulations and protect public assets.

Unauthorized Construction Case

In a separate but related matter, the Holosiivsky District Prosecutor's Office in Kyiv has filed a lawsuit with the Economic Court seeking to revoke ownership rights of an illegally constructed building on Heroes of Mariupol Street. This unauthorized structure covers an area of nearly 246 square meters. The case is currently proceeding through the legal system.

This instance underscores the critical importance of adhering to land lease terms, particularly in the context of safeguarding the rights of territorial communities.

Regaining control over land resources can positively impact infrastructure development and help prevent illegal construction. Simultaneously, the situation with unauthorized buildings emphasizes the need for a systematic approach to regulating land relations in the capital.

This recent ruling illustrates a broader trend in Kyiv, where authorities are actively working to reclaim public land and ensure compliance with lease agreements. For instance, a similar case involving an unauthorized building highlights the ongoing challenges in managing urban development and protecting community interests.
