Court Ruling on Decarlos Brown Jr.
A federal court in the United States has temporarily ruled Decarlos Brown Jr. mentally unfit to stand trial. He faces charges for the murder of 23-year-old Ukrainian national Iryna Zarutska, who died on August 22, 2025, following an attack aboard a train in Charlotte, North Carolina. Under the court’s order, Brown will remain in custody and undergo treatment aimed at restoring his competency to participate in legal proceedings. The decision came after a psychiatric evaluation determined he is currently unable to assist in his own defense or comprehend the trial process.
Outlook for Competency Restoration
Russ Ferguson, the U.S. Attorney for the Western District of North Carolina, stated that the evaluating doctor offered a favorable prognosis for recovery.
“The doctor who conducted the evaluation concluded that the prognosis for restoration is very favorable. So I believe the outlook is good and we will see him in the defendant’s seat,” Ferguson noted.The judge ordered Brown transferred to a specialized federal facility for treatment.
Under North Carolina law, a defendant who cannot understand the proceedings or assist in their own defense cannot be punished, including with the death penalty. Brown, 34, had previously served a five-year prison term for armed robbery and was released in 2022 on a written promise to appear in court. His mother, Michelle Dewitt, 51, has stated that her son suffers from schizophrenia. U.S. President Donald Trump has called for the death penalty in this case.
