Court Orders Companies to Vacate Illegally Occupied Public Land

Two commercial entities have been legally compelled to vacate a municipally owned plot in Kyiv's Desnianskyi district, where they had been operating unauthorized parking lots. The lawsuit was initiated by the Desnianskyi District Prosecutor's Office, which stepped in to safeguard community interests.

The Northern Commercial Court of Appeals upheld the initial ruling, mandating the businesses to clear the public land spanning over 3 hectares, with an estimated value exceeding 122 million Ukrainian hryvnias (approximately $3.3 million). The companies had been using the site for parking lot maintenance and operations without any legal ownership or lease documents.

Prosecutor's Stance and Implications of the Verdict

Prosecutors from the Kyiv City Prosecutor's Office backed the district office's position during the appeals process. Authorities are now taking steps to enforce the court's decision. This information was released by the press service of the Kyiv City Prosecutor's Office.

The ruling highlights the strict enforcement of regulations governing municipal land use and underscores the prosecutor's office's proactive role in defending public interests. By reclaiming the illegally used plot, this case could set a precedent for similar disputes in other parts of Kyiv and across Ukraine, reinforcing that unauthorized commercial exploitation of public resources will not be tolerated.

This recent ruling is part of a broader trend in Kyiv, where authorities are actively reclaiming properties that have been misappropriated. For instance, the city successfully recovered a Podil property valued at nearly 9.8 million hryvnias, reinforcing the commitment to uphold public land rights and prevent illegal commercial activities. Such actions not only protect community resources but also serve as a warning to other businesses operating outside legal boundaries.
