Ukrainian courts and pension indexation
Ukrainian courts support citizens in disputes with the Pension Fund regarding incorrect pension indexation. Recently, the Volyn District Administrative Court declared the practice of replacing pension recalculation with fixed payments illegal. This decision pertains to case No. 140/13894/25 and has a significant impact on pensioners.
According to the court's decision, in 2022, pensioners received 135 hryvnias, and in 2023 and 2024 – 100 hryvnias as fixed payments. However, a pensioner who retired in 2021 won the case, confirming the illegality of such payments. The average salary used in calculating the pension was 9188.81 UAH. Thanks to this decision, the monthly payment to the pensioner will increase from 7214.55 UAH to 10312.8 UAH.
Scale of the problem and opportunities for citizens
In 2025, about 33 thousand similar decisions were recorded in the court register, indicating the scale of the problem with incorrect pension indexation. This underscores the importance of legal decisions in protecting the rights of pensioners and the need to review the practices of the Pension Fund. Citizens who believe their pensions have been incorrectly indexed can take advantage of this decision and apply for a recalculation of their pensions.
This court decision may become an important precedent for other pensioners facing similar problems.
