Judicial rulings that limit price increases in public electricity procurement contracts to 10% are creating significant risks of criminal prosecution for both buyers and suppliers. This cap, applied to contracts signed during a period of sharp market escalation, is causing companies to withdraw from state tenders. The resulting drop in competition threatens the stability of electricity supply to the public sector. Ukraine's energy system is currently operating under a deficit due to lost generation capacity. In these conditions, electricity imports have become critically important, yet their cost is significantly higher and highly volatile. While the market price for electricity can surge by tens of percent, the terms of contracts with state buyers remain rigidly capped. Consequently, many companies are refusing to sign new contracts, reducing their participation in tenders, or even terminating existing agreements.

Roman Zhuk, Director of 'Hazenerho Trade' LLC, stated that 'this ruling potentially creates conditions for the administrative and criminal prosecution of all buyers and all market participants.'
