Military Draft Offices Lose Authority to Detain Registration Violators After One Year

Ukraine's Territorial Recruitment Centers (known as TCCs) are launching a procedure to place military registration violators on a wanted list as an administrative sanction with a limited validity period. According to available information, a search is initiated based on violations of military registration rules, most often when fines remain unpaid within the legally prescribed timeframe. Once a violator is located, the TCC forwards their details to the police for further search and apprehension.

Rules for Imposing Administrative Penalties

It is important to note that being placed on a wanted list is an administrative, not criminal, measure. An administrative penalty for offenses covered by Articles 210 and 210-1 of the Code of Administrative Offenses can only be imposed within three months of the violation being discovered, and no later than one year from the date the offense was committed. After this period expires, the search must be canceled, and TCC notification teams no longer have the authority to detain the individual.

Lawyer Yuriy Ayvazyan emphasizes: 'An administrative penalty for committing, during a special period, offenses stipulated in Articles 210 and 210-1 of this Code may be imposed within three months from the day of its discovery, but no later than one year from the day of its commission.'

Furthermore, if a search is declared for a citizen currently serving in the Armed Forces, it must be revoked. This procedure is designed to enforce compliance with military registration rules and maintain oversight of citizens subject to these regulations.

This initiative by the TCCs underscores the importance of adhering to military service laws, particularly as national defense obligations grow more pressing. It also reflects a tightening of controls over military duties. At the same time, the search procedure as an administrative sanction includes clear limitations to prevent abuse of power and to protect citizens from being unjustly subjected to such measures.
