Illegal Structures Torn Down in Kyiv
Authorities in Kyiv have removed an unlawfully built fence and a bus parking lot from municipal land on Avtozavodska Street in the Obolon District. The nearly 0.1-hectare plot had been fraudulently registered using a fictitious non-residential building. After prosecutors filed a lawsuit, the court ruled in their favor, leading to the demolition of the structures.
The fence and parking area were taken down as part of a court-enforced order. According to the Kyiv City Prosecutor's Office, these installations were set up without the required permits. The estimated value of the land where the illegal constructions stood exceeds 4 million hryvnias.
Fraudulent Registration Scheme
The scheme involved an individual registering ownership of a non-existent non-residential building. A portion of this fictional building was then sold to a private company, which subsequently asked the Kyiv City Council to lease the land. However, the council never approved any lease agreement for that plot.
Prosecutors filed a lawsuit seeking to cancel the ownership registration, invalidate the sale contract, annul the land registration, and remove the fence. The court fully granted the prosecutor's request.
'The prosecutor's office filed a lawsuit to cancel the real estate ownership registration, declare the sale contract for part of the property void, annul the land plot registration, and remove obstacles to land use by demolishing the fence and other structures. The court fully upheld the lawsuit. The court's decision has now been enforced,' the Kyiv City Prosecutor's Office stated.
In a separate case, the Commercial Court of Kyiv ordered a private company to return a nearly 0.7-hectare plot on Liudmyla Protsenko Street to the community—land valued at 32 million hryvnias. Additionally, the Holosiiv District Prosecutor's Office in Kyiv has taken legal action to cancel ownership rights over an illegally constructed building on Heroiv Mariupolia Street, which covers almost 246 square meters.
These cases highlight the prosecutor's office's active efforts to combat the illegal use of municipal land in Kyiv. Such rulings are crucial for protecting community rights to land resources and deterring similar violations in the future. Since unauthorized structures can severely impact local infrastructure and the environment, their removal is a key step in upholding law and fairness in land use.
In light of recent actions taken by Kyiv authorities to dismantle illegal structures, it is essential to understand the broader implications of such enforcement. Similar efforts are underway, as prosecutors are pushing for the demolition of another unauthorized building to reclaim community land. These actions highlight the ongoing battle against fraudulent property claims and the importance of regulatory compliance in urban development.
