A woman sentenced in Zhytomyr who married to avoid mobilization
The court in Zhytomyr issued a verdict against a woman who agreed to marry a man so that he could avoid being drafted into military service during mobilization. This information is provided by the portal «Glavcom», citing tsn.ua.
The Bohun district court in Zhytomyr confirmed an agreement between the prosecutor and the accused, who was charged with facilitating evasion from military conscription during general mobilization.
As a result of the investigation, it was established that the man, who was to be drafted into the army, contacted a lawyer to obtain a deferment. The lawyer's visitors suggested organizing a fictitious marriage with a woman who had a disability.
Attempts to obtain a deferment from mobilization
The woman, who has a second-degree disability, agreed to enter into marriage without the intention of establishing a family. An application for state registration of the marriage was submitted through the Unified State Web Portal of Electronic Services («Diia»).
It is no surprise that the man hoped to obtain a deferment from mobilization according to the law. However, his plans were unsuccessful, as officials from the DRACS department rejected the application submitted through «Diia».
In court, the woman admitted her guilt for aiding in evasion from the draft during mobilization.
According to the terms of the agreement, the accused also committed to providing special information regarding the circumstances of the crime and the participants in this scheme (the conscripted individual and the lawyer).
Details of the verdict
The court found the woman guilty and sentenced her to one year of probation under part 5 of article 27, article 336 of the Criminal Code of Ukraine. The court took into account her repentance, positive traits, second-degree disability, and conspiracy with other individuals. Previously, a court in Zaporizhzhia acquitted a man who was also accused of evading mobilization.
As a result, the intermediary woman in the staged marriage was sentenced for her participation in the crime, but a shorter term was considered due to her cooperation with law enforcement in the investigation of this case.
