Joint Counter-Memorial Filed by Ukraine, Canada, Sweden, and the United Kingdom

On March 27, 2026, Ukraine, Canada, Sweden, and the United Kingdom jointly submitted a counter-memorial against Iran to the International Court of Justice (ICJ). This legal filing is part of a case concerning the jurisdiction of the Council of the International Civil Aviation Organization (ICAO) related to the downing of Ukraine International Airlines Flight PS752 on January 8, 2020. This action represents a significant development in the ongoing international legal effort to hold Iran accountable for the incident.

Background of the Case

The case is being heard under Article 84 of the Chicago Convention, following an appeal on ICAO's jurisdiction. The ICAO Council had previously affirmed its jurisdiction in the matter on March 17, 2025. Flight PS752, a Ukraine International Airlines aircraft, was shot down by Iran's Islamic Revolutionary Guard Corps near Tehran shortly after takeoff. The downing of the civilian airliner, which killed all 176 people on board, provoked global condemnation and raised serious questions about aviation safety and state responsibility. This legal proceeding is one of several international efforts seeking justice for the victims and their families.

The submission of the counter-memorial demonstrates the continued resolve of the international community in a case with profound legal and ethical implications. This step is expected to influence subsequent decisions by the ICAO and could help shape international legal norms concerning aviation security. The ongoing litigation underscores the critical obligations of states to ensure the safety of civilian aviation and highlights the mechanisms for accountability when international norms are violated.
