New Rules for Economic Reservation Take Effect

On May 30, 2026, the Cabinet of Ministers of Ukraine adopted Resolution No. 692, introducing updated regulations for economic reservation and the reassessment of enterprises deemed critical. Under the new rules, all existing critical-status designations will remain valid only until September 1, 2026. Ministries and regional military administrations are now bound by specific deadlines to revise criteria and conduct audits of these businesses. Additionally, the Ministry of Digital Transformation, the Ministry of Defense, and the Pension Fund have been tasked with upgrading digital systems to enable automated data exchange.

Timelines and Restrictions on Status Validity

Current critical-status decisions in effect at the time of the resolution's publication will expire no later than September 1, 2026. By June 10, 2026, government bodies must review and update both regional and sector-specific criteria for granting critical status. A compliance analysis of already-designated enterprises against the new criteria must be completed by July 1, 2026, and a comprehensive review of all criticality decisions is scheduled for completion by September 1, 2026.

The digitalization component requires the Ministry of Digital Transformation to refine the Diia portal within 14 days of the resolution's publication. New criteria must be integrated into the portal's functionality within three days of submission by the respective ministries. The Ministry of Defense, the Ministry of Digital Transformation, and the Pension Fund of Ukraine have until August 1, 2026, to finalize their electronic resources. Subclauses 1 and 3 of the amendments will become mandatory as of September 1, 2026, and agencies must notify the Ministry of Digital Transformation of updated criteria within ten days of approval.
