Legal Challenge Filed Against Government Decree

Lawyers from the legal firm 'Legal Network' have initiated a court challenge against Ukrainian Cabinet of Ministers Decree No. 821, which restricts payments to pensioners, according to attorney Dmytro Korsun. The payment situation deteriorated significantly at the start of 2026 when the Pension Fund ceased calculating supplements, citing a lack of budgetary allocations and the enforcement of this specific decree. In January 2026, individuals received their pensions only at the previous base rate, without any supplementary payments—neither current ones mandated by court rulings nor arrears from past periods. This legal action highlights the ongoing tension between social welfare obligations and fiscal constraints within Ukraine's state budget.

Assurances of a Thorough Judicial Review

The appeal of this government regulatory act is being considered under the rules of general claim proceedings by a panel of judges. In this instance, a panel of three judges is handling the case. According to the lawyer, this structure guarantees the issue will be examined comprehensively, as the decision will affect the lives of many people. Preparatory hearings have been scheduled in four separate cases concerning the appeal of the government decree.

Representatives from 'Legal Network' emphasized the importance of transparency in the judicial process.

"Any person has the full right to freely enter the courtroom, sit in the public gallery, and see with their own eyes how we are defending your rights," stated the firm's representative, Dmytro Korsun.
The attorney also stressed that the legal team does not accept this situation and is categorically opposed to the violation of Ukrainian pensioners' rights, especially during such a difficult period. The lawyers are proposing a mechanism to alter the method of enforcing court decisions through the Treasury Service, which could help influence the restoration of proper payments.

This case is of major significance for many Ukrainian pensioners who depend on timely and full pension disbursements. Given that the funding situation for the Pension Fund remains strained, the court's ruling could impact not only the specific plaintiffs but also the entire pension system in Ukraine.
